TERMS AND CONDITIONS of the www. primavera-home.com online shop


I. General remarks
  1. Online shop available at www.primavera-home.com, hereinafter referred to as e-shop, allows for shopping via the Internet.  
  2. Owner and the entity offering goods via the primavera-home e-shop is the  PRIMAVERA HOME Company with its registered seat in  
    Biała Podlaska 21-500, Brzeska 170a Street (hereinafter referred to as: Seller),
    TIN no.: 5372540534; REGON no.: 361233925.
  3. Buyer can send a filed complaint at: PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska. Faulty goods shall be returned to the following address: PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska.
  4. Seller offers the goods available in the e-shop for the prices specified in the price list, as well as in compliance with those Terms and Conditions.
  5. Buyer is considered a natural person, legal person, or an organizational unit without legal identity, who has registered his or her order and undertaken a payment basing on the available price list, at the same time agreeing for his or her personal data provided in the ordering form to be processed for order management and marketing purposes in compliance with the Act on Personal Data Protection (uniform text – The Journal of Laws of 2002, no. 101, pos. 926, with amendments).
  6. Consumer is considered a natural person co-engaged in a legal acts with the Seller that are not directly connected with his or her business or professional activities.
  7. Seller guarantees that he performs his business undertakings in compliance with best industry practices and in such a way not to distort market behavior of a typical consumer before concluding the agreement for the purchase of chosen goods, as well as during and after its conclusion.

II. Agreement conclusion (making a purchase)  


  1. Orders can be placed 24 hours a day throughout the entire year via the purchasing system being an integral part of the e-shop, as well as via phone from Monday to Friday between 8:00 A.M. and 8:00 P.M.  
  2. Orders placed on working days after 2:00 P.M., on Saturdays, on Sundays, and on holidays shall be processed on the next working day.  
  3. For the agreement to be concluded and for the order to be realized, the Buyer has to provide the Seller with all the data required in the ordering form.  
  4. It is stipulated that the Seller can, in the case of placement of a faulty order (especially when it comes to the provision of inaccurate personal or contact data), refuse to realize an order. For orders the payment for which has been undertaken via bank transfer, the refusal shall be preceded by the return of all the incurred costs to the Buyer at the expense of the Seller and to the account money has been transferred from.  
  5. To make a payment, the Buyer may place an order or register his or her e-shop account. The registration is free of charge. The Seller accepts the responsibility for personal data protection in compliance with the Act on Personal Data Protection (uniform text – The Journal of Laws of 2002, no. 101, pos. 926, with amendments).
  6. Buyer shall have, at all times, full right to have an insight into the account-related data, especially personal data, as well as to correct them, request the withdrawal of their use, and order their deletion.
  7. Seller may contact the Buyer in order to verify the validity of the placed order. The verification procedure shall take place before the order realization process commencement. The said procedure shall be predominantly oriented towards phone or e-mail communication with the Buyer in order to specify the validity of the order. All the costs of such communication shall be incurred by the Seller.
  1. Seller shall provide the Buyer with all the data relating to the ordered goods before shipping them.
 
III. Goods prices and payment-related provisions  
 
  1. Order placement shall be irreversibly connected with the necessity of undertaking a payment for the ordered goods, including the price of the ordered items plus shipping costs.  
  2. Goods price shall be specified in the offer of the e-shop, as well as in the content of the order placed by the Buyer  in accordance with the current price list.  
  3. Buyer can undertake the payment for the goods via advance payment, debit card, eTransfer, or in the cash on delivery form.  
  4. By making an online money transfer, the Buyer is obliged to provide order number as the title of the said transfer. The aforementioned condition has to be met for the order to be realized. Otherwise, the Seller shall attempt to contact the Buyer to be provided with the number. If there is no possibility of identifying a payment made, it shall be returned to the account of the Buyer within 7 (seven) days and the order it relates to shall be considered null and void.  
  5. Bank transfers in Polish Zlotys shall be made to the following bank account: 83 2490 0005 0000 4500 5160 1429  - Alior Bank Ltd. with its registered seat in Warsaw, Łopuszańska 38d Street, 02-232
  6. Goods price includes all the item-related costs meaning that the offered price is a gross price specified in PLN (shipment costs are discussed in section V of those Terms and Conditions).  
  7. Receipt shall be a standard proof of purchase.  
  8. VAT invoices shall be issued for companies and individual entities on Buyer’s request.
  1. Seller shall not be responsible for the realization of Buyer’s order for which advance payment has been made if the payment is not transferred to the specified bank account within 14 days from the day of sending an e-mail notification about order placement (payment via bank transfer or debit card).
 
IV. Order realization and shipment terms  

 
  1. In the case of orders for which the payment has been made via bank transfer, debit card, or eTransfer, the Seller shall proceed to order realization immediately after transfer collection and in the case of advance payments – immediately after order placement.
  2. Buyer cannot modify order parameters after its acceptance.
  3. Shipment shall be realized by a courier delivery company or a firm alike specified by the Seller. Order realization time is calculated from the moment of payment collection.  
  4. Order realization time shall not exceed 35 working days, unless a different timeframe has been provided in product description section or during order placement procedure. In the case of temporal or constant product unavailability, the Buyer  shall be immediately notified about the said fact. If the order includes Products with varying shipment times, the parcel total shipment time shall be equal the longest period of them all. After making prior arrangements with the Seller, there shall be the possibility of partial realization of the order.
  5. Seller shall not be held responsible for the production or transportation delays caused by fortuitous events being outside Seller’s control.
  6. Purchased goods shall be sent to the address provided by the Buyer in the ordering form – it shall be considered the place of order finalization.
  7. Ordered goods shall be delivered to the Buyer by a courier delivery company or a firm alike.
  8. Products sent via a courier delivery company shall be delivered to customers from Monday to Friday at hours typical for a given company. In order to agree upon delivery details, a courier may contact the Buyer via phone (also – via SMS). The Seller shall not guarantee goods delivery at the hour specified in the order.
  9. Courier or any other carrier shall be obliged to unload the parcel from his or her car. Shipment costs, however, do not include carrying items of furniture to Buyer’s house.  
  10. If it is impossible for the Buyer to collect the ordered items on a specific date, the Seller shall be entitled to calculating additional costs for re-shipping or goods storage.
  11. Before collecting the parcel from the courier, the Buyer shall check if it has not been damaged during transport. If so, the parcel shall not be accepted and a shipping damage report shall be made. The Buyer shall also contact the Customer Servicing Department immediately to report the issue. The created shipping damage report shall constitute the legal basis while considering complaints.  



V. Shipping costs
 

  1. Shipping costs shall be sent to be accepted by the Buyer at the end of order placement procedure.  
  2. Individual cost shall be dependent on the dimensions of the parcel to be sent, its weight, shipment destination, and payment method chosen. At all times, total shipping costs shall be made available for the Buyer before order acceptance.
  3. All the payments connected with ordered foods delivery and payment management specified in the order shall be incurred by the Buyer, unless the Seller has decided to organize a promotion exempting the Buyer from the necessity of paying the specified amount in its entirety or in part. Then, the Buyer shall be informed about the said fact before order acceptance.  
  4. Shipment costs shall constitute a separate item in the order and the proof of purchase (invoice or receipt) issued by the Seller for the Buyer. It shall constitute a part of the total order value.
  5. Costs of shipping ordered goods outside Poland shall be agreed upon individually with the representatives of the e-shop. 
VI. Complaints
 
  1. Rights of the Buyer, being a consumer, resulting from this section of those Terms and Conditions are independent from the rights granted to the said party by the Act of 30th May 2014 on Consumer Rights (The Journal of Laws 2014.827).  
  2. If there are qualitative or quantitative faults identified in the purchased goods, the Buyer shall immediately contact the administration of the e-shop in order to resolve the case as soon as possible.  
  3. Differences in hues of the available fabrics, leather, eco leather, wood, and laminated boards, which result from improper monitor display or graphics card settings cannot constitute a legal basis for complaints. Photos published on the website are only informative in character. Both fabrics and hues may differ from the available ones. The color of natural wood may also be different from the one presented on the website.
  4. In the case of ordering an item of furniture to match the previously ordered items, the former may differ in color. Such a state of affairs shall not constitute a legal basis for a complaint.  
  5. Complaint protocol can be downloaded by the Buyer from the website of the e-shop. All of its fields shall be filled in and then sent back to the administration via e-mail. The Buyer shall have the right to make a complaint in both written and digital form.  
  6. If an item is to send back to the Seller, the Buyer shall be required to protect the returned item in such a way to prevent its damaging during transportation. Address for returns: PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska.
  7. Seller shall collect the goods returned by the Buyer from the courier company his own expense.
  8. If the complaint is considered justified, the faulty item shall be exchanged for another, brand-new item. If impossible, the Buyer shall be returned the amount paid for the initial product. In the case of payment being made via debit card, money shall be returned to the bank account ascribed to it.  
  9. Seller shall consider the complaint within 14 days from its collection
  10. Product dimensions specified in the e-shop may differ from those factual ones by +/- 2%, which is caused by the nature of technological processes. Rights to claim compensation for qualitative faults shall be terminated:  
     

1) On the date specified in the warranty certificate providing that such a certificate has been delivered together with the product. Information on warranty duration and the document or page where data on the content of the warranty certificate are provided can be found on the website.
2) In the case of surety – after 2 years from the moment of product shipment  
3) Seller shall be informed about the occurrence of qualitative faults immediately after parcel collection, no later than within 7 days from the said event.


  1. If the Buyer is also a Consumer and the fault has been identified within a year from product delivery, it is assumed that the fault or its cause was present at the moment of collecting the product by the Consumer or a carrier appointed by the said party.
  2. Seller provides fault-free items only.

VII. Buyer-Consumer rights : Agreement termination and item return  
 
  1. If the Buyer has made a decision to terminate the agreement and return the ordered item, he or she shall contact the administration of the e-shop in order to agree upon the mode of return.
  2. Buyer shall be required to protect the returned item in such a way to prevent its damaging during transportation. Address for returns: PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska.
  3. Cash on delivery parcels sent to the Seller shall not be collected.
  4. According to the Act of 30th May 2014 on Consumer Rights (The Journal of Laws of 2014.827 ). The Seller can terminate the agreement without specifying a reason of the said fact within 14 (fourteen) days from the moment of parcel collection. In order for the deadline to be met, a notification shall be sent to the Seller before its elapse (does not apply to products specified in point 5).  
  5. Right to terminate a remotely concluded agreement does not apply  if a custom, modified, or highly personalized item has been ordered by the Buyer. The said provision relates especially to such features of the product as color and material. All items made in accordance with Buyer’s requests  cannot be returned and the right to terminate the agreement does not apply to them.
  6. In the case of cancelling the order for a non-customized item by the Buyer within 2 days from the moment of an advance payment undertaking, the said amount shall be returned in its entirety. If the Buyer cancels the order after 2 days from the moment of order placement, the advance payment shall not be returned.  
  7. Buyer is required to return the ordered item to the Seller or hand it over to an entity approved by the administration of the e-shop immediately, no later than within 14 days from the moment of agreement termination. For the deadline to be met, the item shall be returned before its elapse.
  8. Consumer shall be held responsible for the decrease in item’s value caused by its utilization exceeding the use required to check the nature, features, and performance of the item in question.
  9. Incurred amount shall be returned within 14 (fourteen) days from the moment of reception of the notification on agreement termination. Nevertheless, the Seller reserves the right to withhold money return to the moment of item collection or reception of a confirmation that the item has been sent to the Seller by the Consumer, whichever comes first.
  10. Seller shall return the money in the same way that has been chosen by the Buyer to make the payment, unless the parties have agreed a different money transfer method that is not connected with additional costs. (In the case of payment being made via debit card, money shall be returned to the bank account ascribed to it.)
  11. Buyer may terminate the agreement by sending the Seller a notification about agreement termination. Such a notification may be sent as a filled in form attached as Annex 1 to those Terms and Conditions.
  12. Seller shall not guarantee the possibility of sending agreement termination notifications digitally.
  13. Buyer may return the ordered item via the GLS Courier Company the branch addresses of which can be found here, shipment costs are then covered by the Buyer.
    Buyer shall bear direct item return costs only. Considering the dimensions and weight of some items, item return may be connected with higher shipping costs than while sending it by mail.
  14. Buyer shall be required to protect the returned item in such a way to prevent its damaging during transportation. Address for returns: PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska.
  15. Cash on delivery parcels sent to the Seller shall not be collected.

VIII. Personal data collection
 
  1. Seller agrees to protect the provided personal data in compliance with the Act of 29th August 1997 on Personal Data Protection. According to its provisions, Buyer shall have, at all times, full right to have an insight into the account-related data, especially personal data, as well as to correct them, request the withdrawal of their use, and order their deletion. Data administration principles are provided in detail in Privacy Policy that can be found on the e-shop website.
 
IX.  Intellectual property law
 
  1. Content of the e-shop (images, text, names, brands, photos, and video clips) is exclusively owned by the Seller. Each partial or complete reproduction thereof by using any method and any data carrier has to be prior accepted by the Seller.
  2. All the provided pieces of information, content, and software are protected by intellectual property laws and copyright laws. The Seller may grant the right to copy, view, or distribute the content of the website in its entirety. Each unlawful use of the content by third parties shall be considered a breach of those Terms and Conditions and be subject to legal proceedings.
 
X. Final remarks
 

  1. If the Seller cannot fulfill his contractual duties, he may compensate for the said fact to the Seller by providing a replacement service, being of the same quality, purpose, and price, at the same time informing the Buyer in writing about the possibility of rejecting the service and terminating the agreement followed by item return on the cost of the Seller.
  2. Seller reserves the right to change item quantity and price throughout the day, as well as to remove particular items from the offer or add new ones to it. The said party shall also have the right to change prices, parameters, and shipment costs that do not apply to already placed and confirmed orders.
  3. Law governing those Terms and Conditions is Polish law, especially - Civil Code or, with regard to agreements concluded with consumers, Act of 30th May 2014 on Consumer Rights (The Journal of Laws of 2014.827).
  4. Both parties may claim compensation in court, during mediation proceedings, or in an amicable manner.  
 
 
PROVISIONS ON THE RIGHT TO TERMINATE THE AGREEMENT
 
  1. You may terminate this agreement within 14 days from its conclusion without providing any reason of the said fact. The said right does not apply to items specified in section 7, point 5 of our Terms and Conditions.
  2. Agreement termination right elapse after 14 days from the moment of item collection by either you or a third party not being the carrier or a person appointed by you. In order to take advantage of the right to terminate the agreement, you have to inform us ( PRIMAVERA HOME, Brzeska 170a Street, 21-500 Biała Podlaska, Phone no.: +4883 343 38 13 ; +48 790 215  051 info@primavera-home.com) about your decision to terminate the agreement in the form of a direct notification (having the form of a document sent by mail, via fax, or e-mail).
  3. You may utilize a notification template constituting the Annex to this agreement, but it is not an obligation.  
  4. Seller shall not guarantee the possibility of sending agreement termination notifications digitally.
  5. For the deadline to be met, the information about agreement termination shall be returned before its elapse.
  6. Agreement termination shall result in:
 
  1. In the case of agreement termination, we will return you all the incurred payments, including item delivery costs (except for shipment costs resulting from the choice of a different delivery method than the cheapest one preferred by us) immediately, no later than within 14 days from the moment of collecting the information about your willingness to terminate the agreement.  
 
  1. We will return the money the same way that has been chosen by you to make the payment, unless you have agreed for a different money transfer method that is not connected with additional costs; in each of the specified cases, you will not incur any costs as a result of the return. 
 
  1. We reserve the right to withhold money return to the moment of item collection or reception of a confirmation that the item has been sent by you, whichever comes first.

    4) You will be required to incur direct costs of item return.
